DUE DILIGENCE:
Every business hopes they never find them selves in a courtroom
up against a hefty compensation claim. But the reality is we live
in a compensation culture.
The question that will determine the outcome is:
"Did the: Employer / Business or Company, show due diligence"?
Below are the possible considerations:
Floor Mats:
Placing matting does show a care of duty. However the build up
of dirt from badly maintained mats can be the cause of the problem.
Dirt gets carried from the mat on to the floor causing the slippery
surface. Mats will also absorb the water and remain wet long after
the surrounding area has dried.
Caution Signs:
Once again this does prove you are taking action to prevent an
accident but in many situations this doesn't prevent the public
having to still walk through the problem unless the area is cordoned
off, which in many cases is not possible.
Coefficient floor Level:
At the end of the day you will never stop people falling over
but if you can provide evidence that the friction under the footing
in the wet/dry was up to the HSE required level then this will
be a major consideration to any compensation claim.
